1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and Mondays Marketing Systems LLC ("Mondays Marketing Systems," "we," "us," or "our"). They govern your use of leadwithmondays.com (the "Site"), our forms and website texting feature, and our text messaging program. By using the Site or opting in to texts, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Site.

2. Who can use the Site

You must be at least 18 years old and able to enter into a binding agreement to use the Site or submit information to us. If you use the Site on behalf of a business, you confirm that you have authority to act for that business.

3. Our services and client agreements

Mondays Marketing Systems provides marketing and lead-response systems for home-service contractors. The Site describes our services in general terms. Which services a client receives, and the pricing, scope, and other terms, are set out in a separate written service agreement between Mondays Marketing Systems and that client. If anything in these Terms conflicts with a signed service agreement, the service agreement controls for the services it covers.

Requesting a free business review doesn't obligate you to buy anything, and it doesn't make you a client.

4. No guarantee of results

Information on the Site is provided for general informational purposes. Marketing results depend on many factors outside our control, including your market, competition, pricing, service quality, responsiveness, and customer demand. We don't guarantee any particular number of leads, calls, jobs, reviews, rankings, traffic, revenue, or return on investment. Any examples on the Site, including sample messages and screens, are for illustration only.

5. Text messaging program

Program description:

if you opt in, you may receive text messages from Mondays Marketing Systems about your inquiry, including replies to your questions, scheduling of your free business review, follow-ups, and customer care. If you separately opt in to marketing texts, you may also receive messages about our services and offers.

How you opt in:

by checking the SMS consent box on a form on our Site, by texting us first, or by otherwise giving us express permission. Consent isn't a condition of any purchase.

message and data rates may apply. Check with your mobile carrier for details about your plan.

Opt out:

reply STOP to any message. You'll receive one final message confirming you've been unsubscribed, and you won't receive more texts unless you opt in again (for example by replying START).

Carriers:

mobile carriers aren't liable for delayed or undelivered messages.

Your number:

you agree to give us only a mobile number that you own or are authorized to use, and to tell us if you change or give up that number.

Privacy:

we never share your mobile information or text messaging consent with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy.

6. Using the Site

You agree not to:

• Use the Site for anything unlawful, fraudulent, or harmful
• Submit false information, or information about another person without permission
• Send spam, malware, or harmful code, or try to interfere with the Site's security or operation
• Copy, collect, or harvest content or data from the Site using automated means without our written permission
• Try to gain unauthorized access to any part of the Site or our systems

We may suspend or block access to the Site for anyone who violates these Terms.

7. Information you submit

You're responsible for the information you submit through the Site, and you confirm that it's accurate and that you have the right to share it. We handle personal information as described in our Privacy Policy.

8. Our content and trademarks

The Site and its content, including text, graphics, logos, design, and the "Mondays Marketing Systems" name and logo, are owned by Mondays Marketing Systems LLC or its licensors and are protected by intellectual property laws. You may view the Site for your own informational use. You may not copy, reproduce, modify, distribute, or create derivative works from it without our written permission.

9. Feedback

If you send us suggestions or feedback, we may use them without any obligation to you.

10. Third-party websites and services

The Site may link to or rely on third-party websites and services, such as Google and social media platforms. We don't control them and aren't responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

11. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't promise that the Site will always be available, uninterrupted, secure, or error-free.

12. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, MONDAYS MARKETING SYSTEMS LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR OUR TEXT MESSAGING PROGRAM. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WON'T EXCEED ONE HUNDRED DOLLARS ($100). Some states don't allow certain limitations, so some of these may not apply to you. This section doesn't limit liability under a signed client service agreement, which has its own terms.

13. Indemnification

You agree to defend, indemnify, and hold harmless Mondays Marketing Systems LLC and its owners, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of anyone else's rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts serving Butler County, Ohio, and you consent to the jurisdiction of those courts. Before filing a claim, you agree to contact us at hello@leadwithmondays.com and try in good faith to resolve the issue informally.

15. Changes to these terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. Your continued use of the Site after an update means you accept the updated Terms.

16. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms isn't a waiver. You may not transfer your rights under these Terms without our consent. We may transfer ours in connection with a business transfer. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site.
